The Learning Nest Co – Terms and Conditions
These Terms and Conditions apply to all families accessing services provided by The Learning Nest Co Pty Ltd, including Work + Nest, Crèche, and any parent onsite programs.
By booking, enrolling or attending any service, you agree to the following:
1. Bookings & Cancellations
1.1 A minimum of 2 hours’ notice is required to cancel a booked session.
1.2 Cancellations made with at least 2 hours’ notice will be credited to your account.
1.3 Sessions cancelled within 2 hours of the booking time will be charged in full and no credit or refund will be issued.
1.4 All cancellations must be made via email to info@thelearningnestco.com.
1.5 Any session cancelled by The Learning Nest Co will be automatically credited to your account.
2. Refunds
2.1 Refunds will only be issued where the account is in credit and not in arrears.
2.2 All refunds are subject to a two-week processing period after all required refund documentation has been completed and submitted via email.
3. Fees & Payments
3.1 All Crèche session passes must be paid in advance at time of purchase via the website or EFTPOS in person.
3.2 All casual or individually requested sessions must be paid prior to the session commencing via EFTPOS.
3.3 A late collection fee of $1 per minute for the first 10 minutes, escalating to $5 per minute thereafter, will apply and be charged on the day.
3.4 Any nappies or wipes supplied by the Service will incur a charge of $2.50 per nappy change, payable upon collection.
4. Debt Recovery
4.1 Unpaid services exceeding two weeks past the due date will result in termination of services.
4.2 Outstanding accounts will result in debt recovery procedures commencing.
4.3 If referred to a third-party debt collector, the Service is not responsible for any recovery fees incurred.
5. Refusal of Service
The Learning Nest Co reserves the right to refuse or terminate service if:
Fees remain unpaid beyond two weeks
Harm or threats of harm occur toward any person
Inappropriate behaviour is displayed
WHS standards are breached
Family Conduct standards are breached
6. First Aid & Medical Emergencies
6.1 At least one staff member with current First Aid, CPR, Asthma and Anaphylaxis training will be on site at all times.
6.2 Emergency medication (puffer and EpiPen) may be administered if required and emergency services will be contacted.
6.3 In the event of illness, accident or emergency, first aid will be applied.
6.4 Emergency services may transport a child for medical treatment, and all associated costs are the responsibility of the parent/guardian.
6.5 Parents/guardians must remain contactable at all times and collect an unwell child within 30 minutes of notification.
7. Medication
7.1 All required medication must be supplied in date, in original packaging, with the child’s name clearly labelled.
7.2 A current medical management plan from a registered medical professional must be provided.
7.3 Non-emergency medications (e.g. paracetamol, antibiotics) must be administered by the parent/guardian only.
7.4 Medication must be handed directly to a staff member.
7.5 Emergency medication will only be administered in accordance with the medical management plan.
8. Medical Conditions
8.1 Parents must disclose all relevant medical conditions prior to commencement.
8.2 It is the parent’s responsibility to ensure all medical documentation and updates are provided in writing.
8.3 Where appropriate care cannot be safely provided due to medical needs, sessions may be cancelled and a credit applied.
9. Illness
9.1 Children may not attend while unwell, at the discretion of staff.
9.2 If illness occurs during a session, the child must be collected within 30 minutes.
9.3 If a child under 3 months presents with a fever of 38°C or higher and contacts are unreachable, emergency services will be called.
10. Supervision & Collection of Children
10.1 Children may only be collected by authorised primary contacts.
10.2 Any additional authorised collectors must be provided in writing via email.
10.3 Valid photo ID is required for all collections.
10.4 Emergency contacts will only be used if listed parents/guardians cannot be reached.
11. Court Orders & Custody Arrangements
Parents must provide copies of any relevant court or custody documentation and any subsequent updates via email.
12. Personal Property & Damages
12.1 The Service is not responsible for lost, stolen or damaged personal belongings.
12.2 Parents accept financial responsibility for damage caused by their child or accompanying adults.
13. Photography & Videography
13.1 Photography and videography are prohibited in bathrooms, toilets and feeding areas.
13.2 Parents may only photograph their own child during sessions they attend.
13.3 The Service may use non-identifiable images for marketing, captured in organised sessions with written consent.
14. Staff, Volunteers & Students
14.1 All staff hold current Working With Vulnerable People (WWVP) checks.
14.2 External providers ensure all visiting staff meet Police and WWVP requirements.
14.3 Students and volunteers will be displayed on a foyer notice.
15. Staff Code of Conduct
All staff and external providers comply with the Service’s Code of Conduct. Concerns may be raised at any time.
16. Family Conduct
16.1 Family Conduct Guidelines apply to all participants.
16.2 Breaches may result in termination of services without warning.
16.3 Future service access may be refused without refund.
17. Complaints
Complaints may be lodged via email or in person. Support is available if required.
18. Bathroom, Toileting & Hygiene
18.1 Children have access to the bathroom at all times.
18.2 Parents may attend for nappy changes during sessions.
18.3 Staff will assist children with toileting as needed.
18.4 Parents must supply spare clothing and sufficient nappies/pull-ups and wipes.
18.5 Emergency provision of nappies or clothing will incur a $2.50 fee.
19. Food & Allergies
19.1 The Service is allergy aware.
19.2 All foods containing allergens must be clearly labelled.
20. Sun Safety
20.1 Sun protection measures apply when UV is above 3.
20.2 Parents must supply wide-brimmed hats and personal sunscreen where required.
21. Messy Play & Learning Experiences
21.1 Children may participate in messy and water-based play.
21.2 Clothing may become wet, dirty or stained.
21.3 Multiple spare clothing changes must be provided.
22. Learning Resources
22.1 A wide range of learning resources are used.
22.2 Fragile materials such as glass and ceramics may be used under supervision.
23. Emergency Evacuation
23.1 Evacuations may be directed by South.Point Shopping Centre.
23.2 Children will be escorted safely to the assembly area.
23.3 Children may be collected directly from the assembly point following staff confirmation.
24. Lockdown Procedures
24.1 Lockdown procedures may be enacted during emergencies, including lockout, lock-in or lockdown.
